Extended Consultation (Follow-up)

Description & Practice: 

A 2.5 to 3.0 hour consultation scheduled at 9 15 AM or 2 PM. The meeting format is similar to but not as structured as the initial Consultation & Assessment. Typically, it is the client who sets the agenda.

History: 

Once I began doing the Consultation & Assessment there was a demand for a similar session to be used to discuss the case as it evolved and to reconsider the design and execution of the original plan. There was also a need for inexpensive, periodic support for people working on a settlement through mediation.

Benefits: 

An Extended Follow-up Consultation is useful:

  • In those relatively rare cases so complex that the Consultation & Assessment provided inadequate time to develop a plan sufficiently detailed for the client’s purposes.
  • Anytime during the mediation process when the client wants to "check-in" to obtain an informed, but objective, outsider’s perspective on how the mediation is going and suggestions for improving his or her participation.
  • To review and discuss any settlement agreement before it is finalized as an order or judgment of the court.
  • When the client wishes an inexpensive second opinion about any issue or aspect of the case. Occasionally a client will bring his or her lawyer to the session so that the "second opinion" results from a collaborative effort with the attorney of record.

Limitations: 

The limitations for this service are similar to those of the Consultation and Assessment.

  • I do not consult by phone.
  •  I schedule appointments for this service only at 9 15 AM and 2 PM. The appointment will be scheduled for the full three hours.

Costs: The fee is equal to half of my ordinary and customary fee for three hours. The fee remains the same even if less than three hours is used in consultation, and it is payable at the time of the consultation by check or credit card (MasterCard or Visa).
